The petitioner seeks bail in a case registered under Sections 448, 341, 323, 324, 307/34 of the Indian Penal Code. Allegation against the petitioner is of assaulting the informant's father with heavy stick, as a result of which, he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-12-2019. Charge sheet has already been submitted. There is case and counter case between the parties. Allegation of assault is against co-accused Bhola Kumar. There is no allegation of assault alleged against the

Patna High Court CR. MISC. No.15619 of 2020(2) dt.06-03-2020 2/2 petitioner. Due to petty family dispute, the petitioner has been made accused in this case. Both parties are agnates. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Danapur, Patna in connection with Bihta P.S. Case No. 993 of 2019.
