The petitioner seeks bail in connection with Chandi P.S. Case No. 310 of 2017 registered under Section 25(1-b)a/26 of the Arms Act.

One country made loaded pistol along with a live cartridge is said to have been recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He was not apprehended on the spot rather he was arrested from his house and has been falsely implicated in the case by planting the aforesaid recovery

Patna High Court Cr.Misc. No.4803 of 2018(3) dt.15-03-2018 2/2 from his possession at the instance of his enemy. Though six criminal cases are pending against him, but he is on bail in the aforesaid cases baring one. He has been languishing in custody since 24.09.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, District-Nalanda at Biharsharif in connection with Chandi P.S. Case No. 310 of 2017.
