JUSTICE SUDHIR SINGH ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 392, 411 of the I.P.C. as well as 25(1b)a/26 of the Arms Act and 37(b) of the Bihar Prohibition and Excise Act, 2016.

Allegation is that one artificial gold chain and two live cartridges were recovered from the possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.1.2017 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Patna High Court Cr.Misc. No.31342 of 2017 (2) dt.10-07-2017 2/2 recovered. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Muzaffarpur in connection with Town P.S. case No.38 of 2017.
