The petitioner, in the present case, is seeking regular bail in connection with Chhatauni P.S. Case No.222 of 2017, registered for offences alleged under Sections 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner at the outset submits that it is a case of false implication of the petitioner on mere suspicion. She submits that the petitioner is on bail in all the cases as stated in paragraph 3 of the application. She further submits that a bare perusal of the FIR would show that this petitioner has been named merely on suspicion.

The informant himself

Patna High Court Cr.Misc. No.4920 of 2018 (2) dt.02-02-2018 says that he has suspicion that this petitioner has stolen the motorcycle. Nothing has been recovered from the possession of this petitioner and the police has in fact falsely been implicated this petitioner on mere suspicion.

Learned counsel for the State is present.

Considering the facts and circumstances as also the nature of allegation made in the FIR, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate at Motihari, East Champaran in connection with Chhatauni P.S. Case No.222 of 2017, subject to the conditions U/S 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
