The petitioner apprehends his arrest in connection with Buniyadganj P.S. Case No. 73 of 2018, registered under Sections 302 and 201/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Gaya. The accusation is that since 18.04.2018, Ajay Kumar Sao, son of the informant, was missing on search no trace was found. Thereafter, on 21.04.2018 the dead body of Ajay Kumar Sao was found lying near Muskan Petrol Pump. Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. In course of investigation the Police recorded confessional statement of Arti Kumari, who disclosed that due to her illicit

No.17070 of 2019(7) dt.25-07-2019 2/2 relation with the deceased, her husband Mordhwaj Manjhi in connivance with the petitioner committed murder of son of informant, except the confessional statement of Arti Kumari nothing has been collected by the I.O of this case. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected.
