07-10-2020 Heard learned counsel for the petitioners and learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in Majorganj P.S. Case No. 166 of 2019 registered for the offence under Sections 302, 201, 120(B)/34 of the Indian Penal Code. As per the prosecution case, these petitioners alongwith one co-accused Chotelal Sahni, in order to grab the property of the deceased, have committed the murder of deceased.

It is submitted on behalf of petitioners that petitioner no. 1 is grand son of the deceased and petitioner no. 2 is grand daughter's husband of the deceased. It is further submitted that

Patna High Court CR. MISC. No.16194 of 2020(3) dt.07-10-2020 2/2 there is no eye-witness to the occurrence and only on account of suspicion, petitioners have been made accused in this case. It is further submitted that co-accused Chhotelal Sahni (son of the deceased) has already been granted anticipatory bail by this Court, vide order dated 06-07-2020 passed in Cr.Misc. No. 14285 of 2020. Petitioners have no criminal antecedent, which fact has been stated in paragraph - 3 of the petition. Considering the aforesaid facts and circumstances, the anticipatory bail application of petitioner is allowed. In the event of arrest or surrender within a period of eight weeks from the date receipt/production of copy of this order, let the abovenamed petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No. 166 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
