JUSTICE SANDEEP KUMAR ORAL ORDER 19-06-2024 This revision application has been filed against the order dated 13.06.2018 passed by the learned Sessions/Special Judge, Patna in Special Case No. 37 of 2018 by which the learned court below has rejected the application of the petitioner for release of vehicle which has been seized for the alleged offences under Sections 20, 23, 25 and 29 of the NDPS Act.

2. The petitioner is the owner of the vehicle and he has filed this revision application for release of the truck from which 261 Kg of Ganja was recovered.

3. Learned counsel for the D.R.I. submits that petitioner is accused in this case and is an absconder. Other coaccused persons have been convicted in the trial which they

4. In view of the fact that petitioner who is the owner of the truck is an absconder, this application can only be heard after he appears before the Trial Court.

5. Accordingly, this application is dismissed with liberty to the petitioner to renew his prayer after he surrenders before the Trial Court.

6. It appears that the D.R.I. is not taking interest in arresting the petitioner. The D.R.I. will take all proper steps for arrest of the petitioner.

7. List this case after eight weeks for compliance of the order of this court.
