1. Learned counsel for the petitioners, after some arguments, seeks permission to withdraw the prayer for anticipatory bail with respect to petitioner no. 2, namely, Jitendra Singh.

2. Permission is accorded.

3. Accordingly, the prayer for anticipatory bail with respect to petitioner no. 2 is dismissed as withdrawn.

4. Heard learned counsel for the petitioners and learned A.P.P. for the State.

5. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2),

Patna High Court CR. MISC. No.13842 of 2025(3) dt.12-05-2025 2/3 191(3), 190, 126(2), 115(2), 117(2), 109, 76, 352, 351(2) and 351(3) of the BNS.

6. Learned counsel for the petitioners submits that petitioner no. 1 has antecedent of one case and petitioners no. 3 and 4 are persons with clean antecedent and the informant alleges that on account of dispute relating to land Jitendra Singh assaulted Kapil by an iron rod causing injury on his head thereafter Subhash Singh assaulted Deepak by lathi causing injury on his head.

7. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that on account of dispute relating to land there was an altercation in which both sides assaulted each other but then fairly submits that the order impugned records that the injury of Kapil was grievous but then he was assaulted by Jitendra Kumar.

8. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

9. Considering the submissions made by the learned counsel for the petitioners no. 1, 3 and 4, let the petitioners no. 1, 3 and 4 above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks

Patna High Court CR. MISC. No.13842 of 2025(3) dt.12-05-2025 3/3 from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Rajpur P.S.
