The petitioner apprehends his arrest in connection with Sadar Thana Purnea P.S.Case No.64 of 2015 registered under Section 135 of the Electricity Act.

As per FIR, the informant being Electrical Junior Engineer, Electricity Board, during the course of checking and raid found that the petitioner was a consumer of the Electricity Board vide Consumer No.22786/HA/DA/2573 and his electric connection was disconnected on account of non-payment of arrears dues of Rs.15,692.04 paise. During the course of checking the petitioner was found consuming electric energy in his house by connecting the electric wire on L.T. Line causing loss to the Board amounting to Rs.85,424/ and the raiding party seized 20 meter electric wire.

It has been submitted on behalf of the petitioner that the petitioner is ready to deposit 20 % of the dues amount within a

Patna High Court Cr.Misc. No.21512 of 2015 (2) dt.09-07-2015 2/2 period of 8 weeks in the Board.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, the petitioner is directed to deposit 20% of the dues amount before the Bihar Electricity Board within a period of 8 weeks through bank draft. With the aforesaid condition, the petitioner, named above, in the event of his arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Sadar Thana Purnea P.S.Case No.64 of 2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
