The petitioner is in custody in connection with Mirganj P.S. Case No. 81 of 2016 for the offences punishable under sections 302, 201/34 of the Indian Penal Code. The FIR was lodged by the local Chawkidar and after five days of lodging of the FIR, the father of the deceased in his application to the S.H.O. Mirganj Police Station suspected involvement of the petitioner and his family in the murder of his son. Vide Annexure-3 that is order dated 19.12.2016 in Criminal Miscellaneous No. 44381 of 2016, the father of the petitioner, Kishundeo Sahani @ Krishnadeo Sahani who was named by the

Patna High Court Cr.Misc. No.27018 of 2017 (3) dt.06-07-2017 2/2 father of the deceased vide Annexure-2, was granted bail by a coordinate Bench of this Court. The case of the petitioner is similar to that of Kishundeo Sahani @ Krishnadeo Sahani who has already been granted by on 19.12.2016 in Criminal Miscellaneous No. 44381 of 2016 after perusal of the case diary. Having regard to the fact that the case of the petitioner is similar to that of Kishundeo Sahani @ Krishnadeo Sahani, I am inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj or Successor Court in connection with Mirganj P.S. Case No. 81 of 2016, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and he will not, in any manner, influence the witnesses.
