This matter has been listed under the heading 'To be mentioned' at the instance of learned counsel for the petitioner who makes a limited prayer for disposal of the writ petition with a direction to the District Magistrate, Saran at Chapra to dispose of the application filed by the petitioner in Confiscation Case No.03 of 2013 seeking release of the food-grains seized pursuant to the registration of Daudpur Police Station Case No.140 of 2013 for the offences punishable under section 7 of the Essential Commodities Act.
Having heard learned counsel for the parties and taking note of the limited prayer made by the petitioner, this writ petition is disposed of with a direction to District Magistrate,
Patna High Court CWJC No.3431 of 2015 (2) dt.15-04-2015 Saran at Chapra to consider and dispose of the application filed by the petitioner for release of goods under section 6-E of the Essential Commodities Act, 1955 in Confiscation Case No.03 of 2013 dated 28.10.2014 in accordance with law and after opportunity of hearing to the petitioner within a period of four weeks from the date of receipt/production of a copy of this order.
