JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-09-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and the learned APP for the State Ms. Anita Kumari Singh. The present petition has been filed seeking modification of the order dated 06.03.2020, passed in Cr. Misc. no. 77356 of 2019 to the extent that the time granted to the petitioner for surrendering before the Ld. court of A.C.J.M. III, Patna in connection with Rajiv Nagar PS case no. 376 of 2018,

Patna High Court CR. MISC. No.25120 of 2021(2) dt.08-09-2021 2/2 be extended by a further period four weeks from today. The learned counsel for the petitioner has submitted that on account of the prevailing situation due to Covid 19 Pandemic, the petitioner could not surrender within the stipulated time but he undertakes to surrender within a period of four weeks from today.

The learned APP for the State has got no objection. Having heard the learned counsel for the parties and having considered the submissions made in the present petition, this Court deems it fit and appropriate to extend the time granted to the petitioner to surrender before the learned court of A.C.J.M. III, Patna in connection with Rajiv Nagar PS case no. 376 of 2018, by a further period of four weeks from today in order to enable the petitioner to surrender before the Ld. Court below to avail the privilege of bail.

The petition stands disposed of with the aforesaid modification in the order dated 06.03.2020, passed in Cr. Misc. no. 77356 of 2019.
