JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 275 and 276 of the Indian Penal Code, section 27(6)(ii), 27(9) and 28(A) of the Drugs and Cosmetics Act, 1940.

It is alleged that the drugs worth rupees sixty six thousand and odd were recovered from the unlicenced from the shop of the petitioner.

It is submitted by the learned counsel for the petitioner that the seizure does not suggest that there was any spurious medicine found in the shop of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.14200 of 2016 (2) dt.31-03-2016 2/2 regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Nirmali P.S. Case No. 205 of 2015 pending in the court of learned S.D.J.M. Birpur, Supaul. This application is disposed of with the aforesaid observation/direction.
