01-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Pirpainty P.S. Case No. 120/2017 registered for the offence punishable under Sections 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that nothing has been recovered from his possession, his name has transpired in course of the confessional statement of the co-accused, however he has not been identified till date. It is further stated that the accused on whose confession this petitioner has been involved has been granted privilege of regular bail by a co-ordinate Bench of this Court in Cr. Misc. Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., XI, Bhagalpur, in connection with Pirpainty P.S.
