JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 The petitioner is apprehending his arrest in connection with Mahila P.S. Case No.5/15 for the offence under Section 408/34 of the I.P.C. and Section 3 / 4 of Dowry Prohibition Act. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that though the informant had given Rs.5/- lacs including other valuables in course of the marriage of his daughter, namely, Khushboo Kumari with the petitioner to the parents of the petitioner but they used to
Patna High Court Cr.Misc. No.18009 of 2015 (3) dt.04-09-2015 2/3 demand Rs.2/- lacs more and on account of non-fulfillment of the same they used to assault and torture the victim girl and threatened to kill her.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that there is no chance of reconciliation between the parties. The petitioner is ready to deposit an amount of Rs.2000/- per month in the court below which shall be released in favour of the wife of the petitioner.
On behalf of the learned counsel for the State and the informant it has been submitted that the petitioner is named in the F.I.R. who happens to be the husband of the daughter of the informant.
Considering the aforesaid facts and circumstances, the petitioner is directed to deposit an amount of Rs.2000/- per month in the court below which shall be released in favour of the wife of the petitioner and on his doing so, let the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the
