The petitioner has been in custody since 09.11.2017 in connection with Balia P.S. Case No. 124/2017 registered for the offences punishable under Sections 363/34/ of the Indian Penal Code, Later on, Section 302 of the Indian Penal Code was added. Learned counsel for the petitioner submits that originally when the case was lodged, the informant had alleged the involvement of certain other persons whose names have been recorded in the First Information Report. However, after a lapse of five years as an afterthought, the name of the petitioner has also been taken during the course of investigation by the said informant. No.5799 of 2018 (2) dt.02-02-2018 2/2 back there had been some dispute regarding a piece of land belonging to cousin of the informant and since the petitioner is the adjacent landholder who had been constructing his wall, the dispute has arisen between the parties. Learned counsel for the petitioner further submits that it is only on the basis of conjecture and surmises that the name of the petitioner has been taken. Considering the entire gamut of circumstances and that the petitioner has got no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Balia P.S.
