JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 09-06-2015 The petitioner, who is the husband, apprehends his arrest in Complaint Case No.4024 of 2012 instituted under Section-498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioner draws attention of this Court towards the complaint petition and in particular paragraph-6 thereof wherein it is alleged that both the parties were physically challenged persons (disabled) having suffered from Polio in their childhood. It appears that the husband started ignoring the wife and in order to have reconciliation under a wrong advice resort to legal proceeding under Section-498 A of the Indian Penal Code, which is totally misconceived.

Be that as it may, in the event of arrest or surrender

Patna High Court Cr.Misc. No.17861 of 2015 (02) dt.09-06-2015 2/2 within four weeks from today, the petitioner, namely, Umesh Paswan, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned S.D.J.M., Vaishali at Hajipur in connection with Complaint Case No.4024 of 2012, subject to all conditions as laid down in Section-438(2) of the Criminal Procedure Code.
