The petitioner seeks bail in Triveniganj P.S. Case No. 297 of 2017 registered under Section 304(B)/34 of the Indian Penal Code.
Petitioner along with other accused persons are said to have committed dowry death of the daughter of the informant. It is submitted by learned counsel for the petitioner that the petitioner happens to be father-in-law of the deceased. The allegation levelled against the petitioner is not specific rather omnibus. He has no concern with the aforesaid occurrence. He has been living separately from the deceased and her husband and has no concern with their family affair. He is aged about 60 years and
Patna High Court Cr.Misc. No.12874 of 2018 (3) dt.04-04-2018 2/2 has no criminal antecedent. The petitioner has been languishing in custody since 15.11.2017. Similarly situated co-accused, namely, Fulo Devi, Mithalesh Yadav and Akhilesh Yadav have been enlarged on anticipatory bail by a co-ordinate bench of this court in Cr. Misc. No. 10431 of 2018 vide order dated 27.02.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Supaul in connection with Triveniganj P.S. Case No. 297 of 2017.
