====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 21-09-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for offences punishable under Sections 272, 273, 414/34 of the Indian Penal Code and Section 30 (a) of Bihar Excise Amendment Act, 2016.
It is contended that, as per allegation, 80 liters of country made liquor were recovered from the Tempo of which the petitioner no.1 is said to be the Driver and the petitioner no.2 is passenger. It is urged that the petitioners are in custody since 12.07.2017. It is claimed that their antecedent is clean. Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand)
Patna High Court Cr.Misc. No.43555 of 2017(2) dt.21-09-2017 2/2 each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Gaya in connection with Sherghati (Dobhi) P.S. Case No. 375 of 2017 with a condition that if the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
