Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 324, 504, 506, 379, 34 of the Indian Penal Code and 27 of Arms Act. It is alleged that all the FIR named accused persons including these petitioners armed with knives, sticks and rods came to the door of the informant and assaulted him due to which he fell down and then one of the co-accused persons (Ravi Gupta) took away Rupees 15,000 cash from his pocket. Meanwhile, one of the accused persons made fire with a country-made pistol, in which no one sustained injury.

There is general and omnibus allegation against these petitioners and no overt act is alleged against them. Specific allegation of assault is against coaccused Dharmendra Sah and Ram Dayal Sah. No incriminating material has been recovered from the possession of the petitioners.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M. I, Siwan; in connection with Daraundha P.S. Case No. 218 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
