====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 363 and 366(A) of the IPC. The prosecution story, in brief, is that on 14.11.2019 at about 6.30 P.M. in the evening, the minor daughter of the informant went to attend the nature of call, in the meantime, Sonu Kumar, Malti Devi (petitioner), Madan Manjhi, Vijay Manjhi, Priyanka Devi and Jhaman Manjhi kidnapped his minor daughter for the purpose of marriage.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 06.01.2020. The petitioner has got no criminal antecedent. She has falsely been implicated in the present case. There is no allegation of

Patna High Court CR. MISC. No.12696 of 2020(2) dt.05-03-2020 2/2 tampering with the witnesses alleged against the petitioner. The petitioner happens to be the mother of Sonu Kumar. The victim is said to have been eloped with the son of the petitioner. The petitioner has been made accused just because she happens to be the mother of said co-accused Sonu Kumar. The petitioner is a lady.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
