Considering the submissions made by the learned counsel for the respondent- Bank to the effect that on account of certain technical problems, the auction in question has been cancelled, the learned counsel for the petitioner seeks liberty to move appropriate application for grant of interim orders in the pending case before the learned Debt Recovery Tribunal, Patna bearing SARFAESI Appeal no. 22 of 2019 and further, prays that since the learned Presiding Officer, D.R.T. In view of the submissions made by the learned counsel for the parties, I deem it fit and appropriate to dispose off the present writ petition with liberty to the petitioner to approach the learned Presiding Officer, D.R.T. Patna in the pending appeal for grant of interim orders. It is expected that the petitioner would file the necessary petition within a period of one week from today, so that the same can be listed on 07.03.2020 before the learned Presiding Officer, D.R.T. Patna, for appropriate orders and till then, it is directed that no coercive steps shall be taken against the petitioner herein.
