The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act. Prosecution case is that in the background of nonpayment of extortion demand of rupees five lakhs firing was resorted on the informant though no injury was caused to the informant, leading to registration of FIR against unknown. During investigation, it was found that extortion demand was made through the mobile registered in the name of the petitioner, hence, on the basis of the same, the petitioner has been roped in the present case.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.14262 of 2016 (2) dt.01-04-2016 2/2 that only on suspicion the accusation has been levelled and the mobile of the petitioner was used by someone accidentally. The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Sheohar P.S. Case No.158/2014, pending before the learned CJM, Sheohar. With the above observation, this application is, accordingly, disposed off.
