Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks after restoration of normalcy.

The petitioner seeks bail in Sessions Trial No. 142 of 2018 arising out of Muffasil P.S. Case No. 675 of 2017 registered under Sections 304(B), 120(B)/34 of the Indian Penal Code. Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner is husband of the deceased and the onus is upon him to explain the cause of death of his wife.

A report was called for from the trial court. It has been reported that out of six witnesses, four prosecution witnesses have already been examined and viscera report is awaited.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Patna High Court CR. MISC. No.24955 of 2021(3) dt.15-09-2021 2/2 Considering the nature of accusation and the stage of the case, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is rejected. Learned trial court is directed to take all necessary steps to take all possible steps to conclude the trial of the petitioner preferably within a period of six months from the date of receipt/production of copy of this order.

The District Magistrate and the Superintendent of Police, Samastipur are directed to ensure the production of witnesses on the date fixed by the trial court so that the trial could be concluded within the stipulated period of six months.

Let a copy of this order be communicated to the District Magistrate and the Superintendent of Police, Samastipur for needful. The Director, Forensic Science Laboratory, Muzaffarpur is directed to ensure that the viscera report in connection with the present case be communicated to the trial court at the earliest, preferably within a period of two months from the date of receipt/production of copy of the order.
