ANJANA MISHRA ORAL ORDER 19-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 16.02.2017 in connection with Agion Bazar P.S. Case No. 06/2017 registered for the offences punishable under Sections 376(D), 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that though there is allegation against the petitioner, but there is no evidence of rape in the medical report, which has been received in connection with this case. The allegation as made out against the petitioner also does not stand supported in the case diary. Diary in the present was called for which has since been received.

Learned Additional Public Prosecutor submits that,

Patna High Court Cr.Misc. No.5069 of 2018 (3) dt.19-02-2018 2/2 save and except, the allegation levelled against the petitioner, there is no further material in the case diary to support the allegation against the petitioner.

Considering the period of custody and that the petitioner also is having no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, in connection with Agion Bazar P.S.
