====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------------- 25-06-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Pakaridayal P.S. Case No.30 of 2015 registered under Sections 341, 376, 511, 323, 324, 307, and 504/34 of the Indian Penal Code.

The allegation is that on 11.01.2015, the petitioner dashed the informant, Sita Devi, and removed her cloths with an intention to commit rape on her. On the cry being made by the informant, when her father-in-law rushed at the place of occurrence, the petitioner left the informant and assaulted her father-in-law with Gadasi.

Patna High Court Cr.Misc. No.18286 of 2015 (2) dt.25-06-2015 2/2 Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner had lodged Pakridayal P.S. Case No.27 of 2015 under Sections 341, 323, 324, 325, 504, 506 and 379/34 of the Indian Penal Code against Mathura Paswan, the father-in-law, Gauri Paswan, the husband and brothers-in-law (dewars) of the informant on 01.02.2015 for the occurrence to be taken place on the same day and due to that reason, the father-inlaw of the informant got the present case lodged by the informant against the petitioner regarding the occurrence to be taken place on 11.01.2015 on 02.02.2015, after 22 days of the occurrence.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sikarahana at Motihari, East Champaran, in connection with Pakaridayal P.S. Case No.30 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S.
