The petitioner apprehends his arrest in connection with Paharpur P.S. Case No. 333 of 2019 registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery of liquor has been made behind the shop which has no concern with the petitioner. The petitioner may be granted the privilege of anticipatory bail.

Considering the facts and circumstances of the case,

Patna High Court CR. MISC. No.16066 of 2020(2) dt.12-06-2020 2/2 let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing of personal bond to the satisfaction of learned Additional Sessions Judge-9th -cum- Special Judge, Excise, East Champaran in connection with Paharpur P.S. Case No. 333 of 2019 subject to the conditions laid down under Section 438(2) Cr.P.C.
