JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-06-2023 Heard learned counsel for the appellants, learned counsel for the respondent no.2 and learned Special PP for the State. The appellants apprehend their arrest in connection with Kalyanpur P.S. Case No.270 of 2020, registered for the offences under section 341, 323, 427, 353, 504, 506, 34 of the IPC and Sections 3 (i) (r) (s) of the SC/ST Act pending in the Court of learned 1st Additional Sessions Judge cum Special Judge, SC/ST, East Champaran at Motihari.
After some arguments, learned counsel for the appellants seek permission to withdraw this appeal.
Patna High Court CR. APP (SJ) No.1971 of 2021(4) dt.28-06-2023 2/2 Permission is granted.
Accordingly, this appeal is dismissed as withdrawn. However, if the appellants surrender before the learned Court below within six weeks from today and seek regular bail, the learned Court below shall pass order on the same day in accordance with law, considering the fact that there is a compromise between the parties.
