In this writ petition, the petitioner is seeking a direction to the respondents to grant him notional promotion under the category of B.A. Trained Teacher from the date the junior to the petitioner has been promoted to the said post and also grant monetary benefit from the date his junior has been given the pay scale and also to pay difference of salary till the date of retirement.

In paragraph no.18 of this writ petition, the followings statements have been made by the petitioner:-

That it is also submitted that thereafter the petitioner filed MJC No. 1376 of 2012 wherein the State has filed show-cause stating therein that a Gradation list was published of B.A. Trained Teacher of Schedule Caste category in the year 2010 wherein the name of the petitioner placed at serial no.104 though as per availability of the seat upto the candidate who has placed at serial no.80 was given promotion under B.A. Trained Scale under SC category and as the petitioner was below in the Gradation List he was not given promotion."

In view of the aforesaid statement, there is no merit in this writ petition. Accordingly, this writ petition is dismissed. (Sandeep Kumar, J) pawan/- U
