The petitioner is apprehending his arrest in connection with Complaint Case No. 1004 of 2015 for the offences instituted under Sections 406 and 420 of the Indian Penal Code. As per the prosecution case the petitioner has embezzled Rs.2,45,000/- of the Opposite Party No.2 and misused the conditions of the agreement.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner has falsely been implicated in the present case. Petitioner has already returned the loan amount to the complainant. It is further submitted that the
petitioner shall deposit an mount of Rs.1,00000/- (one lack) in the court below which may be subject to the final disposal of the case. On behalf of the State, it has been submitted that the petitioner is named in the complaint case.
Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs.1,00000/- (one lack) in the court below which shall be subject to the final disposal of the case within a period of three months from the date of receipt/production of a copy of this order, in the meantime, the petitioner shall be granted provisional bail for a period of six months and on doing so, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 1004 of 2015/Trial No.179 of 2015 on furnishing bail bond of Rs.
10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. When the petitioner deposited the entire amount of Rs.
