JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-11-2017 The petitioner seeks regular bail in connection with Gandhi Maidan P.S. Case No. 186 of 2017, registered for offences punishable under Sections 382 of Indian Penal Code. Allegation against the petitioner is of committing theft of motorcycle of the informant.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing ahs been recovered from his possession and further he is resident of other State and has just come to Patna for some of his personal works. Petitioner has been in judicial custody since 06.04.2017. Heard learned A.P.P. also.

Having heard both sides, considering the fact and circumstances of the case, this application is disposed of with

Patna High Court Cr.Misc. No.45341 of 2017 (3) dt.07-11-2017 2/2 direction to the court below to verify the address of the petitioner and after being satisfied, the court below shall release the petitioner on bail to his own satisfaction with the condition that :- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of his bail.
