JUSTICE PARTHA SARTHY ORAL ORDER 31-08-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Runnisaidpur P.S. Case No. 429 of 2019 registered for the offence under section 392 of the Indian Penal Code.

As per allegation in the FIR, while the informant was returning from duty, four accused persons on the point of pistol took away Rs. 8,000/- and other articles of the informant. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. No incriminating article has been recovered from the possession of the petitioner. He has not been put on T.I. parade and he is in custody since 4.11.2019.

Having heard learned counsel for the parties and going through the records of the case, it transpires that the informant refused to participate in the T.I. parade. Thus, taking into consideration the submissions made on behalf of the petitioner, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Runnisaidpur P.S. Case No. 429 of 2019 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
