The petitioner seeks bail in a case registered for offences under Section 30(A)/(D) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

It is contended that as per allegation, 5 litres of Mahua liquor were recovered from the hut of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 12.06.2017.

Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten

Patna High Court Cr.Misc. No.37145 of 2017(3) dt.25-08-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Bhagalpur in connection with Sultanganj P.S. Case No. 16 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
