JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-06-2015 The petitioner, who is a rice mill owner, apprehends his arrest in relation to Nanpur P.S. Case No.01 of 2015 instituted under Sections-409 and 420 of the Indian Penal Code by the Block Development Officer, Nanpur, Sitamarhi alleging, inter alia, that government paddy was given to him for milling and returning the rice, which he had not done.

Learned counsel for the petitioner submits that in fact as alleged no paddy was supplied. This is corroborated by the affidavits given by the driver of the truck stating that on the date alleged in the F.I.R. no paddy was given to him to deliver to the petitioner. It is further submitted that if at all it is a matter of accounting and civil dispute.

Mustafa Khan alias Mustafa Khan, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Pupri in connection with Nanpur P.S. Case No.01 of 2015 (G.R. No.01/2015), subject to all conditions as laid down in Section-438(2) of the Criminal Procedure Code.
