The petitioner seeks bail in a case registered for offences punishable under Sections 30(a), 38(1) and 41 of the Bihar Prohibition and Excise Act, 2016.

As per allegation, 13 liters and 305 ml. of foreign liquor were recovered from the graveyard. Petitioner has been implicated in this case on the basis of confessional statement of the co-accused. Petitioner claims his antecedent to be clean and he is in custody since 29.05.2017.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of A.D.J.

Patna High Court Cr.Misc. No.32087 of 2017 (2) dt.13-07-2017 2 / 2 II-cum-Special Judge, Excise Act, Sitamarhi in connection with Belsand P.S. Case No.20/17.

Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
