JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 The petitioner seeks regular bail in connection with Agion Bazar P.S. Case No. 174 of 2018, registered for offences punishable under Sections 341, 323, 307, 447, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioner is of firing on the informant, however, the said firing did not hit anybody and later on villagers caught him and handed him over to the police along with one empty cartridge and motorcycle.
It has been submitted on behalf of the petitioner that from the F.I.R. itself it is evident that the firing did not hit anybody and as a matter of fact, he has falsely been made accused in this case due to village politics and he has been in judicial custody since 30.12.2018.

No.18508 of 2019(3) dt.21-05-2019 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VIII, Bhojpur at Ara, in connection with Agion Bazar P.S. Case No. 174 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
