Petitioner, already in custody, seeks bail in connection with Dumraon P.S. Case No.258 of 2017, arising out of POCSO Case No.31 of 2017, registered under Sections 323, 341, 366(A), 376 and 504 of the Indian Penal Code as well as under Section 8 of the POCSO Act.
Allegation in brief is that the prosecutrix eloped with the petitioner and lived in Delhi but later on refused to marry her. Learned counsel for the petitioner submits that the girl is major, she voluntarily eloped with the petitioner and there was consensual relationship.
Having considered the said facts and circumstances, petitioner Jitendra Choudhary is directed to be released on bail
Patna High Court Cr.Misc. No.10525 of 2018(2) dt.22-02-2018 2/2 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I-cum- Special Judge SC/ST & POCSO Act, Buxar in connection with Dumraon P.S. Case No.258 of 2017, arising out of POCSO Case No.31 of 2017.
