1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Gadhpura (Garhpura) Police Station Case No. 8 of 2025, dated 26.01.2025, disclosing offences under Sections 30(a) of the Bihar Prohibition and Excise Act and Sections 161(2)/281/3(5) of the Bhartiya Nyaya Sanhita.

3. The prosecution case, as per the First Information Report, is that the police on the basis of secret information intercepted a truck having registration no. BR09-GC4078, from where 705.37 liters of illicit liquor has

Patna High Court CR. MISC. No.13695 of 2025(2) dt.03-04-2025 2/3 recovered. The driver of the truck fled away, however, one person sitting on the truck was apprehended, who disclosed that the phone calls, which were coming from the mobile no. 7631988920, is of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been made accused on the basis of his being the owner of the truck, in question. He next submits that the truck was being plied by a driver on hire basis and the petitioner was not aware about the illicit liquor being kept therein by the driver. He further submits that the mobile number, which has been disclosed by the arrested accused person, does not belong to the petitioner. The petitioner has got no criminal antecedent.

Having regard to the submissions made on behalf of the parties and taking into consideration the justification given by the petitioner that the truck was being plied on hire basis and the petitioner is having no criminal antecedent, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.
