JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2017 The petitioner seeks regular bail in connection with Kargahar P.S. Case No. 32 of 2017, registered for offences punishable under Sections 341, 323, 304B, 201 and 34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. Petitioner is husband of the deceased and allegation against him is of killing the deceased for demand of dowry. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact the deceased died due to diarrhea as she has complained of stomach pain and while taking her to hospital, she died mid way. Further petitioner has been in judicial custody since 22.04.2017. Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and

Patna High Court Cr.Misc. No.32734 of 2017 (3) dt.07-08-2017 circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the petitioner may renew his prayer for bail after framing of charge in this case.
