ANJANA MISHRA ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 27.12.2017 in connection with 58C2/2017 arising out of P.R. No.56 dated 27.12.2017 registered for the offence under Section 37(b) of the Excise Act.

Learned counsel for the petitioner submits that only on the basis of the breath analyzer test, the petitioner has been taken into custody. It is further submitted that there is no recovery from his possession.

Considering the aforementioned facts and circumstances and the nature of allegations made, let the petitioner, above named, be released on bail on his furnishing

Patna High Court Cr.Misc. No.5533 of 2018 (2) dt.01-02-2018 2/2 bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise, Lakhisarai, in connection with 58C2/2017 arising out of P.R. No.56 dated 27.12.2017.
