JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-12-2022 After having heard learned counsel for the petitioner and the opposite parties, it has transpired that this Court's order dated 16.03.2018, passed in CWJC No. 10441 of 2011, has been complied with.
Learned counsel appearing on behalf of the petitioner has, however, submitted that though the order has been complied with but belatedly, for which the petitioner is entitled to due compensation in the form of statutory interest. On perusal of the order of this Court dated
Patna High Court MJC No.714 of 2019(12) dt.07-12-2022 2/2 16.03.2018, I do not find any direction issued by this Court for payment of statutory interest. Non-payment of statutory interest therefore, in the facts and circumstances, does not constitute deliberate disobedience of this Court's order. It goes without saying that the petitioner shall be at liberty to raise before appropriate Forum/Court, his claim for payment of statutory interest on delayed payment of the amount, which has already been paid to him.
The contempt proceeding stands dropped with the aforesaid liberty.
