Petitioner is languishing in judicial custody since 27.02.2018 in connection with Kotwa P.S. Case No. 34 of 2018, G.R. No. 1009 of 2018 for offences punishable under Sections 379, 414, 411/34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that while he was returning from his sister's house and on the way was talking to his friend, three persons in a motorcycle came and snatched away his motorcycle. On information by the local villagers, the name of the petitioner was revealed as one person involved in taking his motorcycle.
It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.22528 of 2018 (2) dt.19-04-2018 2/2 petitioner that he is innocent, bears no criminal antecedent, motorcycle was not recovered from his house but near a college and because of personal enmity and money dispute, he has been made accused.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-X, Motihari, District-East Champaran in connection with Kotwa P.S. Case No. 34 of 2018, G.R. No. 1009 of 2018. (Nilu Agrawal, J) Devendra/- U T
