18-06-2015 Heard Sri Amresh Kumar Sinha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Complaint Case no.538 of 2013 registered for the offence under Sections 406, 420 of the Indian Penal Code, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that though the petitioner had taken Rs. 1,50,000/- as loan from the complainant and he had returned Rs.1,13,000/- and for the rest amount the petitioner had given a blank cheque to the complainant, but the complainant himself filled up the cheque to

In view of nature of accusation, the Court considers that it is a fit case for extending the privilege of anticipatory bail. Let the petitioner, namely, Arvind Tiwary in the event of his arrest or surrender within a period of one month from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K.Singh, learned Judicial Magistrate, 1st Class, Araria in connection with Complaint Case no.538 of 2013, subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure.
