JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody since 26.3.2016 in connection with Khutauna P.S. Case No. 24 of 2016 for the offence under sections 413, 414, and 401 of the Indian Penal Code.

Counsel for the petitioner submits that other coaccused namely, Rama Nand Yadav was arrested at the spot along with the petitioner, was granted bail vide order dated 22.2.2017 in Cr. Misc. No. 50249 of 2016 and other co-accused, namely, Ghuran Mian Minya was granted bail in Cr. Misc. No. 20907 of 2016 vide order dated 21.07.2017 and Ram Bharosh Yadav was granted bail vide order dated 29.9.2016 in Cr. Misc. No. 40438 of 2016.

Since the other co-accused including accused Ram

Patna High Court Cr.Misc. No.27383 of 2017 (3) dt.06-07-2017 2/2 Nand Yadav who was apprehended along with the petitioner has already been granted bail by this court on the ground of parity, I am inclined to enlarge the petitioner named above, on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Jhanjharpur, Madhubani or the successor court in connection with Khutauna P.S. Case No. 24 of 2016, G.R. No. 454 of 2016 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, tamper with the evidence or influence the evidence or the witnesses.
