JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 This is an application for grant of anticipatory bail in connection with Bagaha P.S. Case No. 519 of 2018, disclosing offences under Section 363 of the Indian Penal code. Prosecution case as per FIR is that the informant had gone with his daughter-in-law to the hospital for checkup of delivery of child and admitted in the hospital and his grand son aged about three years was missing and on search he was traceless from the hospital premises and they suspected the hands of the petitioner, who is Asha worker in the hospital. Submission of learned counsel for the petitioner is that only on the suspicion, the petitioner has been made accused and the CCTV footage disclosed that the boy was going with other person and later on the boy was also recovered.

Having heard both sides, in view of the facts and circumstances as stated above, let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/-( Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Bagaha, West Champaran in connection with Bagaha P.S.
