JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 19-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Rahika P.S. Case No. 159 of 2022, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) Bihar Prohibition and Excise Act. The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and is under custody since 09.02.2023 for the allegation that 137.160 liters of foreign liquor was recovered from his house.

Considering the above-mentioned facts and circumstances as well as clean antecedent and period of custody, let the petitioner above-named be released on bail on furnishing

Patna High Court CR. MISC. No.14031 of 2023(2) dt.19-05-2023 2/2 bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge Excise Act, Madhubani in connection with Rahika P.S. Case No. 159 of 2022, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
