2. The petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 226 of 2024 registered for the offence under Sections 103(1) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the petitioner and his wife were fighting and when the deceased intervened in the fight between the petitioner and his wife, the petitioner threw the deceased on the road due to which he sustained head injury.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 22.09.2024.

Patna High Court CR. MISC. No.13870 of 2025(3) dt.09-05-2025 2/2 vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case, I am of the opinion that it does not appear to be a case of homicide as the occurrence has taken place during a dispute between a husband and wife and when the deceased intervened he was thrown on the road and he sustained injury on his head.
7. In view of the above, this application for regular bail is allowed.
8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st Class, Naugachia, Bhagalpur/concerned Court below in connection with Gopalpur P.S. Case No. 226 of 2024.
