The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504, 506 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 23.10.2021 at 6:30 PM, when the informant was standing at his door talking to his mother, when informant's cousin Vinod Rai (petitioner) along with Vinay Rai came and started abusing them and when informant protested, it is alleged that petitioner assaulted him with an iron rod causing injury on his head on the order of Vinay Rai, it is next alleged that Savita Devi and Roshni Devi assaulted informant's mother and
Patna High Court CR. MISC. No.14507 of 2022(2) dt.19-09-2022 2/3 snatched her Jitiya and Vinay Rai and Roshni also dashed his mother on the ground. It is next alleged that thereafter a Panchayati was held and when the accused refused to accept the Panchayati, the present FIR came to be instituted. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that petitioner and the informant are related as has been disclosed in the FIR, it is next submitted that there is land dispute between the parties and the date of occurrence is 23.10.2021 and the FIR came to be instituted on 18.11.2021 i.e., after a delay of nearly more than 25 days without any plausible explanation which creates doubt with regard to veracity of the allegation, as alleged in the FIR.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case
