JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06.09.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Trial court has reported that charge against the petitioner has already been framed on 19.8.2017 and the matter is pending for recording the evidence of the prosecution witnesses.

Petitioner happens to be husband of the deceased and earlier his prayer for bail was rejected by this court. Therefore, in the aforesaid circumstances, again, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Session trial no. 39/2017 arising out of Hilsa P.S. Case no. 216/2016

Patna High Court Cr.Misc. No.34534 of 2017 (3) dt.06-09-2017 pending in the court of Addl. Sessions Judge II, Hilsa, Nalanda stands rejected.

However, learned trial court is directed to expedite the trial of the petitioner and conclude the same as early as possible preferably, within six months from the date of receipt/production of a copy of this order, failing which petitioner shall be at liberty to renew his payer for bail before the trial court itself.
