2. The petitioners have filed the present Writ Petition for a direction to the respondents to grant the benefit of Assured Career Promotion Scheme to the petitioner which has not been given to him in spite of specific order passed in CWJC No. 2459 of 2006.
3. Learned counsel for the State fairly submits that the issue involved in the present Writ Petition has already been
Patna High Court CWJC No.5116 of 2016(4) dt.21-01-2025 2/2 decided by this Hon'ble Court and this issue has been decided in the case of Kamlanand Thakur Vs. The State of Bihar and Ors. passed in CWJC No. 18727 of 2017.
4. In this view of the matter this Writ Petition is disposed off directing the petitioners to file a fresh representation in light of the judgement rendered in the case of Kamlanand Thakur (supra) within four weeks from today. Upon filing of the said representation, Respondent No.4, namely, the Joint Secretary, Department of Labour and Secretary, Department of Labour and Employment, Government of Bihar, New Secretariat, Patna shall pass a reasoned and speaking order within 90 days thereafter.
5. With the aforesaid observation and direction, the present Writ Petition stands disposed off.
